The Legal Stuff
My goal is to please my customers by providing the highest quality images and photographic products possible at reasonable prices. That said, I simply cannot give away the farm and remain in business. Under Copyright Law in these United States the copyright to a photograph is the sole property of the photographer. Therefore no one may legally reproduce a photograph for any purpose without the photographer's express permission. Of course as one who makes his bones selling photographs and photographic items, I am extremely reluctant to give any sort of permission for reproduction of my photographic images by others. When I sell a photograph I DO NOT ever sell the copyright. I retain the copyright to every image I shoot and register each one with the U. S. Copyright Office.
I fully understand that many people believe that since the photograph is of them or their family members that they have the right to reproduce the image at will. That’s an interesting concept but it is simply not true. So when customers ask if they can just download images from my website, I generally say, “Yes, but only low-resolution images are available for download.” And of course the downloaded images are intended for sharing on social websites and in e-mail and similar uses; not for printing.
Aside from the loss of revenue from customers printing images from my photography there is also the issue of quality. In fact, that is probably my primary concern. When I provide a photograph to a customer, either via personal delivery or from my website, I am certain that it is the best possible representation of the image; that there are no compromises in quality. Since I have no control over the printing processes used elsewhere, clearly I cannot predict the results or how they will reflect upon my professional reputation. My experiences with snapshot printers has ranged from good (but not great) to shoddy.
One other issue is my personal guarantee. If I provide you with a photographic image and you are not completely satisfied, I will make it right to the very best of my ability. Clearly, I cannot say anything about images printed by others. Keep in mind, however, that there are things I cannot possibly address. If for some reason I missed the shot you really wanted, clearly there is no possible way to undo that sort of problem. On the other hand if there is a problem with the composition or color balance of an image, those can be addressed.
And finally a word about prices. Mine are as reasonable as I can make them. I know that there are those who sell similar services for less. I have no quarrel with them—they know what their work is worth.
